Hmm... I suppose that might be the case. I've always just made a a habit of going to My Downloads and performing the updates everytime I open the Market, since I have found such inconsistency with the notifications. I'd think something like this would not require opening the Market to trigger an update notification scan. Maybe with the next Market upgrade they can beef up the customization and allow the user some control... maybe let me set an update scan interval, or allow it to get notified when apps open and check for a new version at that time, among other things...
