Market only uses the information from the manifest. It doesn't know against which version of Android you linked your project.
So yes, you can compile against the API 4, but you need to make sure that you really test your app on a 1.5 device/emulator to ensure that you're not use 1.6 API by mistake, or it'll crash on 1.5 devices.
