You are perfectly allowed to sell applications, just not via this one channel. Android Market is not the be-all and end-all of distribution channels. Many serious applications won't be on the Market, just as many serious WinMo applications aren't sold on their non-existent Market equivalent. You are not going to find medical record management applications on the Market, for example. Rather, those will sold through other channels, such as direct sales to physicians. Now, if your mission in life is to make an application that simulates flatulence, the Android Market is probably the best channel. And there is little question that the Android Market's current terms means US-based flatulence app developers have a market advantage. If you are serious about selling Android applications, all of the hullabaloo about the Android Market's limitations should be a minor annoyance at most, because the Android Market should be one channel among many you are targeting, and so the impact of that Market's present failings won't be that substantial. And your marketing efforts should be channel-independent, so you can steer people to other places to get your app (other markets, your Web site, etc.) if the Market is not available to you. This is not to say that Google is "off the hook". Communications about Market-related issues have been dismal, and many of the issues themselves are unfortunate at best. And Google will wind up with Market acceptance problems as a result.
