The reason he was pulled from the iPhone App Store is not due to quantity of apps, but because his apps violated the terms of the App Store: http://www.mobilecrunch.com/2009/08/03/apple-bans-app-stores-3rd-most-prolific-developer/ (in particular, see the "Notice of Termination" email he was sent by Apple) At some point, he may cross the threshold for "create a spammy user experience, whether by posting repetitive content or misleading information about an application's purpose" (from http://www.android.com/us/developer-content-policy.html). However, if you can amass evidence on other fronts, such as copyright violations, that may help expedite changes.
