The clerk you talked to is miss-informed..check the T-Mobile boards its been covered there before..it is not illegal to buy a G1 from someone one other than t-mobile..
It is true that recently t-mobile changed their policy to tie voice plans with data plans.. I would if you remember the clerks name ask that if its okay to buy a Droid from Verizon instead since they want you to have the option of a month to month plan.. Just so you know the 2nd biggest number of deployed G1s is in fact China behind the US..
