Dear Chairwoman Murray, Chairman Hensarling, and Members of the Joint Select Committee on Deficit Reduction:

If the Joint Select Committee recommends granting the FCC incentive auction authority, the undersigned companies and organizations urge you preserve the FCC's flexibility to ensure continued access to unlicensed spectrum for Super Wi-Fi in the TV bands nationwide, and in each local TV market.

Maintaining access to unlicensed spectrum in the TV band is critical to innovators, consumers, businesses, and the U.S. economy.Conservative estimates of even just a fraction of current Wi-Fi technologies show that /_unlicensed technologies contribute $16-37 billion annually to the economy.Overturning the FCC's bipartisan decision to designate this spectrum for Super Wi-Fi threatens tens of billions of dollars in additional investment that our economy desperately needs_/.

Contrary to some recent statements, industry is moving quickly to deliver new and innovative Super Wi-Fi offerings in the TV bands.Importantly, the FCC has already designated spectrum for Super Wi-Fi and completed its rules in two bipartisan, unanimous decisions, the IEEE, the Wi-Fi Alliance and other groups are developing standards for deploying Super Wi-Fi networks, and manufacturers are in the process of bringing devices to the market.This means that the huge benefits of Super Wi-Fi will be realized in the near future.Super Wi-Fi products are expected in the marketplace as early as next year.As recently as October 19, Julius Knapp, the FCC's Chief Engineer stated that, "I can assure [you that] there are people who are moving forward through the certification process" for TV white spaces devices.On the other hand, the benefits of auctioned licensed spectrum would not be evident for many years due to the time, risk, and inevitable broadcaster litigation involved in re-packing the TV bands, conducting spectrum auctions, and having the eventual winners build out new licensed networks.

Unlicensed spectrum has been, and continues to be, a powerful catalyst for innovation and job creation, and is currently used by millions of devices in millions of locations.It is also a powerful complement to licensed spectrum use, as mobile broadband providers are increasingly using Wi-Fi networks to offload traffic from their licensed cellular networks.Recent studies show that nearly half of all global IP traffic will flow over unlicensed spectrum by 2015, as compared to approximately 8 percent flowing over licensed mobile networks. Indeed, today, more traffic flows over unlicensed networks than on all licensed wireless networks combined.

We urge Congress to give the FCC the flexibility to preserve TV band spectrum for unlicensed Super Wi-Fi devices and deliver innovation to American consumers and economic growth to our Nation.
