Note that if this is a problem then you can always use the free implementation
that Andrew Selkirk from OJE wrote. See <http://oje.sourceforge.net/>.
From the README:

    This extension is a clean room developed extension
    conforming to Sun's JCP 1.1 draft for JAXP.  The
    code in javax.xml is licensed under the LGPL.  The
    code in org.w3c.dom is licensed under the W3C
    Software license and all remaining code is covered
    by the Apache Software License.
