Because this is what it does right now.  All tasks that support nested
<fileset>s will fail if they received non existent things from them.

Peter has already convinced me that you are talking about something
different form today's fileset, which doesn't mean I'd understand why
a set transformation had to be nested into a set definition, much less
why this would be "the proper place" for the transformation.
