AP. 20 September 2002. U.N. Tribunal Charges Croatian Gen.

THE HAGUE -- A retired Croatian Army general was charged by U.N.
prosecutors with murdering and terrorizing Serb civilians in the former Yugoslavia.

Gen. Janko Bobetko, 83, is the most senior Croat ever sought by the
Hague tribunal, whose war crimes cases have overwhelmingly been against
Serbs, including former Yugoslav President Slobodan Milosevic.

In Friday's indictment, prosecutors claimed that Bobetko knew his troops
were killing civilians and prisoners of war during a 1993 attack on a
Serb-dominated area of Croatia known as the Medak Pocket.

Bobetko failed to prevent or punish the crimes, despite being in a
position of authority which enabled him to do so, the indictment asserted.

He was charged with five counts of violations of the laws and customs of
war and crimes against humanity for the "unlawful killing of at least
100 Serb civilians and or wounded soldiers," the indictment said.

Bobetko, who was the Croat army's chief of staff in the early 1990s,
told reporters in Zagreb Friday that he won't surrender alive.

"I made a final decision: They can only take me dead from this house,"
he said from his home.

The Croatian war erupted in 1991, when Serbs, backed by the Yugoslav
army, took up arms to rebel against Croatia's decision to break with
Yugoslavia. The fighting ended four years later when Croatia recaptured
lands seized by the rebels.
