Data retention obligations imposed on businesses should be scaled back
and replaced with the federal government’s digital identity scheme or
other privacy-preserving methods, according to the Law Council of Australia.
The peak body representing Australian lawyers made the comments in its
submission to Commonwealth review of data retention requirements,
joining others pushing for greater use of the Australian Government
Digital Identity System (AGDIS).
A handful of other submissions to the review have also called for
clearer data obligations to prevent the over-retention of sensitive
personal data, with companies often adopting a “conservative approach”
in the absence of clarity.
