Dear readers, Generally, I'd consider this Nevada only news not worth posting to the Slick eZine list, but it struck a nerve. The Democrat Nevada AG is playing the same game that led to Tom Delay's resignation from the GOP leadership. In his case you might remember, District Attorney Ronnie Earle brought his case to an Austin Grand Jury, and then *never* sought an indictment. Instead he "leaked" accusation after accusation including a fairy tale of "money laundering" to the liberal press. Earle has since retired but the new D.A. continues to hold the threat in abeyance, just in case Tom Delay chooses to re-enter politics. (Think how different the Republican Party would be if it had a strong leader like Tom Delay instead of that guy Hastert?) Any way, it appears this unscrupulous democrat tactic is alive and well in Nevada. Read on. Gov. Brian Krolicki having to do with a college savings program Krolicki oversaw a few years ago while he was the state Treasurer. Here's what we don't know: Exactly what Krolicki is going to be accused of, or whether there will be any merit to the charge(s). And here's what else we know: This entire matter stinks of politics. As Anjeanette Damon of the Reno Gazette-Journal reports this morning: "Prosecutors generally have two avenues with which to seek criminal charges: a grand jury indictment or filing a criminal complaint. A grand jury meets in secret and the accused has no ability to cross examine the accuser. If an indictment is not obtained, the entire proceeding is kept confidential." So without even knowing what he *might* be charged with, every newspaper in Nevada today has Krolicki's pending indictment splashed across its front page. That causes political damage to a man who less than two weeks ago indicated he might consider running against Democrat U.S. Sen. Harry Reid in 2010. Coincidence? Yeah, right. Remember, it's not paranoia when they're really out to get ya. And even if, by some miracle, the grand jury opts not to indict Krolicki - since, as the saying goes, prosecutors can get a grand jury to indict a ham sandwich if they want to - "the entire proceeding is kept confidential." Confidential, maybe. But anything but harmless. The mere act of seeking the indictment irrevocably harms Krolicki, both in his future business and political endeavors, as his attorney pointed out in a letter to the AG yesterday. By shrouding this action in the secrecy of a grand jury, where he and his lawyers don't even know what he's being accused of, let alone allowed to offer evidence or mount a defense, Krolicki is screwed whether he did anything wrong or not. Which is probably why Masto opted for the "star chamber" route rather than file a traditional criminal complaint where "a public preliminary hearing is held before a justice of the peace who decides whether prosecutors have enough evidence to try the accused in district court." It's so much easier to kick the living snot out of your opponent when he's bound, gagged, and blindfolded. Again, we don't know what Krolicki will even be accused of, let alone whether he's guilty of any wrongdoing. Yet by her actions, Masto has Krolicki's political future hanging by a thread. No matter what you think of Brian Krolicki personally or politically, this smells to high heaven. *WHAT IT'S ALL ABOUT* The whole brouhaha appears to be from the results of a politically- inspired legislative audit of the Nevada College Savings Plan conducted in 2007 by a Democrat-controlled committee chaired by the most partisan, left-wing member of the Legislature, Assemblywoman Sheila Leslie of Reno. To give you an idea of exactly what kind of partisan witch hunt Leslie conducted in this matter, she wouldn't even allow Krolicki to testify before her committee. The man was forced to present information about the program and its administration during the abbreviated "public comment" period. Nor did Leslie bother to share the results of the audit with Krolicki before she went public with them. Now, according to the RGJ report this morning, here's the essence of the cooked audit Leslie's committee came up with: "*The audit found the treasurer's office properly managed the money invested by parents in the savings program. It also accounted for every dollar that was spent outside of the state's financial system, finding no money missing* ." So Brian Krolicki properly managed the money and accounted for every dollar. And for THAT he's being hounded and indicted? And this ISN'T political? Gimme a break. Of course, maybe the AG has new "evidence" of wrongdoing. But we don't know that. Because if she does, she's hiding it from the public. It's guilt by innuendo. It's an abuse of the grand jury system. If Catherine Cortez Masto has evidence that public servant Brian Krolicki committed some kind of criminal acts, then she should tell the public exactly what it is she's accusing him of and give the accused an opportunity to defend himself. Don't hide behind the secrecy of a grand jury. *REID HIM HIS NON-RIGHTS* Two final points here: First, Harry "Pinky" Reid spokesman Jon Summers, responding to the understandable musings about the head Democrat's possible involvement in the Krolicki indictment, said: "Sen. Reid has not been involved in any way in this inquiry." And technically, that's probably true. But in reality, children are always looking for ways to impress adults in power. Neither Leslie nor Masto needed any direct prodding by "Pinky" to launch a partisan attack against a political opponent once they smelled blood. So understand that Reid's approval was understood without being overtly encouraged. Secondly, let's compare how Masto is dealing with Brian Krolicki compared to how she and her office are dealing - or more to the point, not dealing - with a Reid flunky accused of financial shenanigans. I'm talking about Bob Loux. Loux, executive director of the Nevada Office of Yucca MountainDisinformation, has publicly admitted to ripping off taxpayers by giving himself and his staff secret pay raises without permission. And yet Masto, claiming a "conflict of interest," has punted any criminal investigation of this Reid loyalist. Indeed, Loux is actually still on the job and will be allowed to retire with full benefits. Meanwhile, the AG is decidedly conflicted in the Krolicki investigation, as well. "In fact, several current and former senior deputy attorneys general have been intimately involved in the drafting and approval of all contracts pertaining to my former office, as were all parties to the State Board of Examiners," Krolicki noted in a written public statement to Nevadans yesterday. "If any of the contracted activities in my former office are the subject of her accusations, this is essentially a process whereby the Attorney General is pursuing criminal charges against the former State Treasurer for activities that were prepared and approved by…the Attorney General!" I guess not all "conflicts of interest" are created equal. So did Harry Reid call Masto and tell her to give Loux a pass? Of course not. Did Masto understand that giving Loux a pass would make "Pinky" happy - and prosecuting him would make "Pinky" unhappy. Bet your bippy. Did this calculation enter into the AG's decision to hound Krolicki and give Loux the Looter a get-out-of-jail- free card? Who knows? To suggest such would be to besmirch someone's reputation without giving that person a fair opportunity to defend herself. You know, like what Masto is doing to Krolicki. "I respectfully ask the citizens of Nevada to keep an open mind as the legal process proceeds in the coming weeks and months, and I submit that you will come to view this exercise for what it truly is – not a prudent prosecution, but a partisan persecution," Krolicki concluded in his statement yesterday. "My resolve to fight this matter shall not waiver, and when this terrible episode is concluded, you will know without doubt that I never betrayed your trust or confidence." And when that day arrives, Brian Krolicki will need to contact Ray Donovan and find out where that office is you need to go to to get your reputation back. ------------------------------ *I'M MAD, AND I'M NOT GOING TO TAKE IT ANY MORE. *------------ --------- --------- --------- --------- --------- --------- --------- ----- With ACORN, La Raza, and Ohio Dem officials sitting on 20,000 suspect voter registrations and other Dept heads releasing Joe the Plumber's confidential information, this has been an incredibly, uncreditable election.
