from Bill Walker FOAVC co-founder <[email protected]>
I respond with the following points as noted below: Bill Walker FOAVC co-founder www.foavc.org http://foavc.org *Constitutional Convention* http://targetfreedom.typepad.com/targetfreedom/2009/02/constitutional-convention.html Article V of The Constitution lays out the only two ways to change The Constitution: 1. The Amendment process: A specific, and clearly defined, change that is limited to what is written in the amendment. 2. A Constitutional Convention: A process to scrap the entire constitution and replace it with something else. ANY type of amendment can be considered. 1. Please provide proof of these assertions either by Supreme Court ruling or by other citation. You've given your opinion regarding this, now provide proof that this is what Article V says. Otherwise you have not proven your point. I could state the moon is made of swiss cheese but unless I can prove it with irrefutable evidence, it's my opinion and nothing more. Provide a citation other than your own opinion to prove your statements. Mr. Walker quotes Chief Justice Warren E. Burger: "If you have the best automobile in the world, you don't throw it away if the carburetor is not working. You fix it," he said. "The same is true of the Constitution. That's what the amendment process is all about." U.S. Supreme Court Chief Justice Warren E. Burger, Boston Globe, August 21, 1987 Apparently Mr. Walker understands the difference between the effect of The Amendment process and calling for a Constitutional Convention. 2.The matter is "peremptory." Therefore the rest of your arguments are meaningless. A convention must be called. 3. Quoting Warren E Burger, December 20, 1985, AP story," In a question and answer session at the National Press Club on Thursday, Burger shrugged off criticism that the convention, approved so far by 32 of the 34 states [by the way according to figures I just got tonight, the actual number of applications now stands at 710] could abridge rights guaranteed by the founding fathers. "I don't think it would pose a threat," he said. But, he added,"It would be a grand waste of time." Therefore Warren E. Burger, whom everyone on your side has always quoted when he is quoted correctly, states he doesn't feel a convention would be a threat. 4. You've given us your opinions. Now back them up. Give one example where any convention has done anything you say will happen. You have nearly a 1000 to pick from. Hysteria proves nothing. If the government was, as you indicate, so inclined they could have called a convention at anytime during the last 100 years. 5. "They would simply propose those amendments." Duh! That's what a convention does Mr. Perna, it proposes amendments. The rest of your over active imagination isn't worth the time to respond to. Facts, references, proof Mr. Perna. Don't throw a book at me and expect me to cower. Open the thing up and provide a quote, a reference, proof. You say there are "thugs." Name them. Show me the major political movement that will do what you say. Show me where they have the support of the American people in such vast numbers they can do what they say. Then explain to me how this vast powerful group of "thugs" are so politically impotent they can't get Congress to call a convention so they put their massive scheme into motion. We understand that there are those who want to destroy the American constitution. We also understand that it would be foolish for those thugs to admit that it is their goal to destroy the American constitution. It would be much more clever if those thugs were to claim that they only wanted to make a few small changes. Of course, if it was true that they only wanted to make a few small changes, then they would not need a Constitutional Convention. They would simply propose those amendments. Imagine this scenario: You wake up in the middle of the night to a noise in your living. You grab your gun, and you find two thugs loading bags full of valuables. You hold the gun at the ready. One of the thugs says: "Now that is a really fine gun. But you really need to clean it. Why not hand it over to me, and I will clean it for you." The other thug says "Oh there is nothing to worry about. If you do not like the way he uses the gun then of course you can insist that he give it back!" You would say "How stupid do you think I am?" When we see someone asking us to hand over the gun of a constitutional convention, we must conclude that he is one of two things: 1. He is an unbelievably stupid fool OR 2. He is a thug, with an ulterior motive, who thinks that the WE are unbelievably stupid. There is a limit to the amount of time for which it is possible to assume that this is an unbelievably stupid suggestion, being made because of mere stupidity. Eventually it will become clear that we are dealing with a thug, with an ulterior motive, who thinks that the WE are unbelievably stupid. IT WILL BE JUST AS EASY to ignore a new constitution as it is to ignore the one that we have now. IT just will NOT BE NECESSARY to ignore a new constitution, since it will say what the New World Order wants it to say. The problem is not what the constitution SAYS. The problem is what OUR GOVERNMENT DOES. We need to change what OUR GOVERNMENT DOES. We do not need to change what the constitution SAYS. After that, we look at our God given rights contained in our Declaration of Independence*. ** *"The Congress…on the application of the legislatures of two-thirds of the several states, shall call a convention for proposing amendments…" Article V, USCON* ** At the same time, academic exercises like this can serve secondary purposes. Just like last month we learned that a man could become president without proving he meets the minimum Constitutional standards to become president, we now know as a matter of fact, the Congress can also legally ignore the Constitution. *"No person except a natural born citizen, or a citizen of the United States, all be eligible to the office of President..." * *Article 2, Section 4, USCON* ** *The govt has trampled our precious constitution to death and has breached the contract with We the People that authorizes its very existence. By their own actions, or inactions, they have become a defacto outlaw govt. They have no standing!* ** *It's time we demand our state legislatures to form a new and less imperfect nation.* Rich Martin -------------------------------------------------------------------------------- -- This is the incredibly uncreditable election.
