Austrian and German courts protect identity
file-sharers
The music industry has suffered a severe setback by
two verdicts by courts in Munich and Vienna. Both
courts ruled that internet service providers did not
have to hand-over data about customers. In the Munich
case, the Higher Regional Court squashed an earlier
verdict that obliged providers to hand-over data about
users suspected of operating illegal FTP servers. In
July the music label BMG was granted the right to
demand information from an access provider, but the
execution was suspended during the appeal procedure.
BMG even demanded information from the provider on the
number of tracks and albums of individual bands or
artists downloaded from the server named in the
complaint. The Munich appelate court said they had
serious doubts "whether the defendant threatened with
the injunction is an actual participant in the -
alleged - infringement of copyright" and specifically
added "it is obvious that the contested ruling cannot
conceivably continue to stand."

Eli Noam: Heroes of the internet frontier
The US Supreme Court agreed last week to hear the
music industry's case to shut down file-sharing
websites such as KaZaA, Grokster and eDonkey. These
operations enable users to download millions of songs
from each other for free instead of buying at least
some of them in a music store. In aggregate, the
traffic generated by music and video file-sharing can
account for more than half of all internet traffic.
Music companies, their revenues in decline, have been
trying to suppress these "peer-to-peer" (P2P)
practices in the courts, legislatures and by spreading
deliberately defective copies of songs. They view P2P
users as thieves who must be prosecuted. But
traditional media companies should perhaps see P2P as
to their long-term advantage because it helps create
new markets and forms of distribution.

copyright owners to control digital copies of their
material. In this piece, Kimberlee Weatherall examines
the case and its policy implications, and considers
the various possible interpretations of the
anti-circumvention provisions. She argues that, in
light of the tortured legislative history of Digital
Agenda amendments and current reviews, the
unprecedented and expansive nature of these laws, and
some of the comments about statutory interpretation in
The Panel case, the High Court should take a cautious

employee monitoring in the European Union, the United
States and Canada in an attempt to reconcile
conflicting legal standards regarding workplace
privacy as they are evolving simultaneously with
technological advances. Included is an extensive
discussion of the European Union�s widely influential
privacy directive and its application in the context
of electronic employee monitoring, relevant U.S.
legislation such as the Electronic Communications
Privacy Act (ECPA), HIPAA and the ADA, and Canada�s
newly enacted Personal Information Protection and
Electronic Documents Act (PIPEDA). Also included is a
detailed comparative analysis of the regulatory
approaches to employee privacy taken in these

Abstract: In the age of the Internet many traditional
legal principles acquired new meaning, or at least the
necessity to be redefined. It is particularly true in
respect of the ability of states to prescribe the laws
for online activities and to enforce them on Internet
users. International law does not object to the
extension of state jurisdiction beyond the state
boarders and even provides an arsenal of generally
accepted principles. However, automatic application of
these principles leads to worldwide liability of any
Internet author for simple creation of a webpage,
without any other connection with a possible forum.
Whereas certain Internet activities are similar to
those in the physical world, such as e-ommerce, where
the partners can at least identify each other and get
the warning of legal order, others are substantially
different, and among them online expression. As the
Internet is now, there are not too many possibilities
to control the spread of online content apart from not
speaking on the Internet at all, and they are
connected with significant burden for all

validity of the established principles of
extraterritorial jurisdiction and to ensure that their

The Clear and Present Internet: Terrorism, Cyberspace,
and the First Amendment by Peter Margulies
Many terrorist groups share a common goal with
mainstream organizations and institutions: the search
for greater efficiency through the Internet. This
pursuit of on-line efficiency has spawned a First
Amendment dilemma. The Internet�s ability to link
geographically dispersed individuals to changing data
without the filtering provided by traditional media is
a substantial asset for domestic and transnational
networks, from violent white supremacist groups to Al
Qaeda. However, much of the Web�s terrorism-related
content, including the abstract advocacy of violence,
has manifest value as an exercise of free speech.
Modern First Amendment jurisprudence protects extreme
speech as a form of engagement in the polity, and
responds to fears that unleashing the government on
speakers will permit the targeting of groups outside
the perceived mainstream. Nevertheless, some Internet
communications intended for the mobilization and
implementation of violence should forfeit protection.
