I had the same problem last month and was using Beyond 2.6.16 kernel..
When I replaced the driver, it worked and I told it to iphitus.. (hope
the nick is correct) He said, he would change it but I really don't know
the status of it..

Have you tried 2.6.17 ? Maybe, it's replaced in that kernel..?

You can also submit a bug report about this, since it was the main idea
people have told me..
