The Government Accountability Office (GAO) today issued the following legal 
decisions and opinions of the Comptroller General:

String King Lacrosse, LLC, a small business of Gardena, California, requests 
that our Office recommend that the Department of Health and Human Services 
(HHS) reimburse the firm the reasonable costs of filing and pursuing its 
protests with respect to request for proposals (RFP) No. 75A50322R00008. The 
solicitation sought proposals for disposable medical isolation gowns for use 
during public national emergencies and pandemic events. We dismissed String 
King's most recent protest--its second protest with our Office concerning this 
solicitation--as academic on April 9, 2024, prior to the submission of the 
agency's report, based upon the agency's notice of corrective action. The 
requester argues that it should be reimbursed the costs of pursuing both of its 
protests because, in each instance, the agency unduly delayed taking corrective 
action in the face of a clearly meritorious protest.

We deny the request.

Effective October 1, 2024, the Electronic Protest Docketing System (EPDS) 
filing fee for new protests will be $500.  Pursuant to 31 U.S.C. § 3555(c), GAO 
is authorized to charge a filing fee to support the establishment and operation 
of an electronic protest filing and document dissemination system.  GAO has 
determined that a fee adjustment is warranted in order to ensure that GAO 
recovers the costs to establish and operate the system.
