The Government Accountability Office (GAO) today issued the following legal 
decisions and opinions of the Comptroller General:

*Bid Protest Decisions:*

B-422634, Ashton Marine Company, September 5, 2024

Ashton Marine Company, a small business of Muskegon, Michigan, protests the 
award of a contract to Midwest Construction Company, LLC, a small business of 
Nebraska City, Nebraska, under request for proposals (RFP) No. W912P624R0006, 
issued by the Department of the Army, Corps of Engineers for the delivery of 
armor stone to six Lake Michigan harbors. The protester contends that the 
agency unreasonably eliminated Ashton's proposal from the competition and 
failed to conduct meaningful and equal discussions.

We deny the protest.

B-422251.7, Federal Working Group, Inc., September 10, 2024

Federal Working Group, Inc. (FWG), of McLean, Virginia, protests the issuance a 
task order by the Department of the Treasury, Office of the Comptroller of the 
Currency (OCC), to Intellect Solutions, LLC, pursuant to request for quotations 
(RFQ) No. 2031JW23Q00021, to perform various information technology (IT) 
services. FWG challenges several aspects of the agency's evaluation, including 
the agency's determination that the key personnel resumes FWG submitted 
rendered its quotation unacceptable. Protest at 14-15. FWG also asserts that 
the agency's evaluation of Intellect's quotation was flawed. Id. at 20-21.

ITility, LLC, of Chantilly, Virginia, protests the terms of fair opportunity 
proposal request (FOPR) No. FA564124R0006, issued by the Department of the Air 
Force for technical and analytical services. The protester contends that the 
agency improperly changed the criteria for award without a rational basis.

We deny the protest.

Venergy Group, LLC, a small business of Fort Pierce, Florida, protests the 
exclusion of its proposal from the competition conducted under request for 
proposals (RFP) No. W912HN-23-R-4002, issued by the Department of the Army, 
Corps of Engineers for general and design-build construction projects issued by 
the Army's Savannah District in Georgia. The protester challenges the 
evaluation of its proposal and the decision to exclude it from the second phase 
of the competition.

We dismiss the protest as untimely.

Communications Services; Implementation of the Martha Wright-Reed Act; Rates 
for Interstate Inmate Calling Services, September 10, 2024

GAO Reviewed Federal Communications Commissions' (FCC) entitled "Incarcerated 
People's Communications Services; new rule entitled "Implementation of the 
Martha Wright-Reed Act; Rates for Interstate Inmate Calling Services." GAO 
found that the final rule (1) implements the expanded authority granted to FCC 
by the Martha Wright-Reed Act to establish a compensation plan that ensures 
both just and reasonable rates and charges for incarcerated people's audio and 
video communications services and fair compensation for incarcerated people's 
communication services (IPCS) providers; and (2) fundamentally reforms the 
regulation of audio and video communications services provided in all 
correctional facilities, and significantly lowers the IPCS rates that 
incarcerated people and their loved ones will pay.

Enclosed is our assessment of FCC's compliance with the procedural steps 
required by section 801(a)(1)(B)(i) through (iv) of title 5 with respect to the
