The Government Accountability Office (GAO) today issued the following legal
decisions and opinions of the Comptroller General:

*Bid Protest Decisions:*

B-422342.2, Chevo Consulting, LLC, August 30, 2024

https://www.gao.gov/products/B-422342.2?utm_campaign=usgao_email&utm_content=gcdecisions&utm_medium=email&utm_source=govdelivery#mt=e-report
 ]

Chevo Consulting, LLC, of Rockville, Maryland, protests the issuance of a task
order to J&M Global Solutions, LLC, of Alexandria, Virginia, under task order
request for proposals (TORP) No. 70FA6023Q00000004, issued by the Department of
Homeland Security (DHS), Federal Emergency Management Agency (FEMA), for
program management services. Chevo argues that the agency unreasonably
evaluated Chevo's proposal under multiple evaluation factors.

We deny the protest.

B-422576.2, CymSTAR, LLC--Reconsideration, September 10, 2024

CymSTAR, LLC, of Broken Arrow, Oklahoma, requests reconsideration of our
decision, "CymSTAR, LLC", B-422576, July 31, 2024, 2024 CPD ¶ 172, wherein we
denied its protest challenging the terms of fair opportunity request for
proposals (FOPR) No. FA8617-24-R-B001, issued by the Department of the Air
Force for the acquisition of a maintenance training system (MTS) for the
agency's fleet of T-7A aircraft. CymSTAR argues that our decision contained a
factual error.

We deny the request for reconsideration.

B-422881, Ecology Mir Group, LLC, September 12, 2024

Ecology Mir Group, LLC (EMG), of Fairfax, Virginia, protests the issuance of a
federal supply schedule (FSS) purchase order to another vendor under request
for quotations (RFQ) No. N3220524Q4076A, issued by the Department of the Navy,
Military Sealift Command, for lodging negotiation and management services. EMG
argues that the agency unreasonably evaluated its quotation as technically
unacceptable.

We dismiss the protest as untimely.

contractor teaming arrangement (CTA) of International Business Machines
Corporation (IBM) and Capital Technology Group, LLC (CTG), of Bethesda,
Maryland, by the Department of Homeland Security, U.S. Citizenship and
Immigration Services (USCIS), under request for quotations (RFQ) No.
70SBUR24Q00000004 for information technology (IT) services. Slalom protests
various aspects of the agency's evaluation and source selection decision.

We deny the protest.

*Congressional Review Act:*

B-336637, Department of Health and Human Services, Centers for Medicare &
Medicaid Services: Medicare and Medicaid Programs and the Children's Health
Insurance Program; Hospital Inpatient Prospective Payment Systems for Acute
Care Hospitals and the Long-Term Care Hospital Prospective Payment System and
Policy Changes and Fiscal Year 2025 Rates; Quality Programs Requirements; and
Other Policy Changes, September 12, 2024

GAO reviewed the Department of Health and Human Services, Centers for Medicare
& Medicaid Services' (CMS) new rule entitled "Medicare and Medicaid Programs
and the Children's Health Insurance Program; Hospital Inpatient Prospective
Payment Systems for Acute Care Hospitals and the Long-Term Care Hospital
Prospective Payment System and Policy Changes and Fiscal Year 2025 Rates;
Quality Programs Requirements; and Other Policy Changes." GAO found that the
rule (1) revises the Medicare hospital inpatient prospective payment systems
for operating and capital-related costs of acute care hospitals; (2) makes
changes relating to Medicare graduate medical education for teaching hospitals;
(3) updates the payment policies and the annual payment rates for the Medicare
prospective payment system for inpatient hospital services provided by
long-term care hospitals; and (4) makes other policy-related changes.

Enclosed is our assessment of CMS's compliance with the procedural steps
required by section 801(a)(1)(B)(i) through (iv) of title 5 with respect to the
rule. If you have any questions about this report or wish to contact GAO
officials responsible for the evaluation work relating to the subject matter of
the rule, please contact Charlie McKiver, Assistant General Counsel, at (202)
512-5992.
