That's what I've seen. My dev server was restored from pre-production with some of the forms already overlaid, but not all, and almost none of the workflow. I am all SP1 (plus hotfixes); too many things just don't work properly in 7.6.04.00, especially overlays, and that could be part of your problems. Auditing doesn't work for overlays at all until hotfix 2.
