To the best of my knowledge, there was never a problem with any of the prior versions as with the current versions when creating a "unique" index if the criteria for a unique index are already met.
That field must have a value with no duplicates (beware NULL is a value so cannot be repeated). I'm assuming you might have already checked for duplicates among non null values. Have you checked for duplicate NULL values? Also for further clarity (just in case you are missing something critical) could you line up the steps you took in order to create that unique index - including steps taking to create an overlay in the event you are creating this index on a form that is an OTB form considering you make a mention of overlays in your posting..
