Hi Bhabesh,

In the absence of any written agreement, the cheque is sufficient as
evidence. Kindly talk to him directly and try solving it outside
court, in case u think its late already, talk to a lawyer and then
give him a notice about paying the amount sooner.

In the meantime, let me check with the relevant sections in Indian Law
regarding such kind of frauds..

Dear Relative,
I understand you are having some financial problem and thats causing
you to delay the payment. I can totally understand as I am having the
same issue. Can you please give me give me 1 lacs right now. That will
solve my problem temporarily and at the same time, it will give you
enough time to return the rest of the money ..
 
Do the same next month. Personally, I don't think he has wrong
intention to keep your money.

Dear Friends,

one of my relative borrowed money from me (few lacs) saying he will
return it within one month. the money was given by cheque (my
account). three months have passed but the money is not returned and i
feel he is avoiding now.

no written agreements were made. only the cheque is a proof of giving
money. (i think he can't claim that i gifted the money since he is
financially much more sound than me.)

can i go to court for recovering the money?

Please advice....... ..
