It depends on whether or not your local vendor actually owns the number itself or acquires it from another vendor. If they own the number, I don't think they're legally allowed to refuse to port it. If they lease the number from another provider, they're not actually obligated to assist you in porting, although they might, if you ask nicely, tell you with whom you need to deal to port the number.
