I doubt there is any issue. The issue in most other parts of the world is 
terminating third-party calls onto the GSM network without paying the GSM 
operators their exorbitant termination costs.

Since in Canada terminating to GSM phones is no different than terminating to a 
landline, I don't see why there would be any legal distinction.

Now, the question whether terminating third-party calls using a "consumer" 
service, be it GSM or landline, is an issue is a whole other discussion.
