The rate control in ath9k_htc is done in firmware , so we are not updating the tx rate to user space .We are looking into this issue.To make sure that the tx rate is high you can look into the ath9k_htc debugging feature tgt_stats. For this enable CONFIG ATH_DEBUG=y CONFIG_ATH9K_HTC_DEBUGFS=y in config.mk in your compat wireless.
