Actually.....no. It doesn't matter if you're making money off of it or not. Nintendo are famously takedown happy when it comes to free fan made games, AM2R and Pokemon Uranium. While it's true you can't copyright ideas. You can copyright specific parts of a game, the Sims concept itself isn't copyrightable, but the Sim creator, that most certainly is. The sounds are, even things like the pointer used, or the way the screen blurs out to censor things are copyrighted.. It's a common myth that if you aren't making money it's not infringing. It most certainly is.
That beeing said....I don't think EA will come knocking, because there's enough differences clearly show hey, this is not a direct clone of tS3. It is its own thing.
