I don't think it's as simple as that.  MP3 uses a psychoacoustic model
to decide which spectral information to retain.  VBR gives it the
additional freedom to "concentrate" on certain parts of the file, so it
might well allow the differences to be greater in parts of the file
where they matter less, for example because the power is mostly in some
frequency range in which human hearing is less sensitive. 

Can you hear the difference (in either file) from FLAC?
