Hi,

I also got this problem on a Kernel without CONFIG_USER_NS
(3.10.9-1-zen), so it's _not_ user namespace related.

You can easily reproduce this by doing the following:

Create some "base image" (I did with pacstrap, but every "linux for a
chroot with a /sbin/init inside" should work)
Create a cow directory
Create an aufs mountpoint

mount  -t  aufs  none  /path/to/root  -o
br=/path/to/cow=rw:/path/to/base_image=ro

Create the lxc container inside libvirt (easy to do with virt-manager)
Start the container
Power off the container

Now try to touch files inside /path/to/root. you get EROFS.
