This is correct. OOo 3.x implements the ODF version 1.2 and one of the noticeable change compared to ODF version 1.0/1.1 is the way the position of lists is managed. In order to preserve the appearance of the lists we should save the documents as ODF 1.1 (this option has been added in Tools > Options > Load/Save) but I think it makes sense to migrate as soon as possible to the new version.
