I think you're very confused and not particularly clear on how mail works.
If gnu.org occurs in the headers, the post went through the mailing list;
gnu.org is not, to my knowledge, running any open relays. The example
that you quoted was spam to the [EMAIL PROTECTED] mailing list, which is
why the envelope sender was [EMAIL PROTECTED] (the mailing list
software sets that automatically).
