Well, I wouldn't claim to have much experience in this, but I agree with your points. If I read the ASF license correctly, then I, the user, take over any responsibility, when I download and install that stuff. I've always taken that clause at face value - if something goes wrong, I wouldn't think of complaining to the ASF or even going to court. I'd make some suggestions on how to fix the problem or send in a patch myself, but if it wasn't accepted, then I'd simply turn to another product that suits my needs better - or I would patch my local copy of the software.
