There was a patch submitted to cvs that fixed the above issue on September 21st - long before the release of Phoenix 4.0.2 (October 29th). However, that patch isn't included in the 4.0.2 release: it doesn't carry the 4.0.2 release tag in cvs and is also not included in the binary download for 4.0.2 (decompiled org.apache.avalon.phoenix.components.manager.MX4JSystemManager to check).
Also, a fairly important-looking patch has been made to that class six days ago (stopping services upon dispose), so how about making a new release?
