I've also been thinking down the same lines for a while...  
But I do not think the solution is to deliver MIME only when the request is 
MIME.. Some might expect a MTOM response for a normal message.. Also if needed 
people can enableMTOM service wise or better yet operation wise....

How about introducing a new value to 'enableMTOM' as 'optional', which will do 
the behaviour mentioned in this JIRA... I think this 'optional' value is 
something we should consider for most of our config options..
