JAX-RPC and JMS are programming interfaces -- above the OSI stack (in the application realm).
The proprietary wire protocol used underneath a JMS implementation is a layer 7 protocol.
The OSI stack isn't a very effective metaphor for explaining middleware protocols. Almost all of middleware technology runs in layer 7 and higher -- yet there are many layers in most middleware environments.
