The main problem (i did not try it) of your sample files is the xinclude
namespace declaration :
*replace* http://www.w3.org/1999/XML/xinclude with:
http://www.w3.org/2001/XInclude

Be also aware that Xinclude occurs at the very beginning (infoset
merging).
