The experience with Linux and SCO serves as something of a cautionary tale. Even if the cause is groundless, there's a lot of hassle possible when someone decides you're a worthwhile target. OTOH, if BackupPC (however you define it) has no money, there's really not much reason for lawyers to go after it.
