Darryl, thanks. does seem to work :). (btw, isn't the second from the
end line unnecessary? for me the script generates two new documents
with this line :)).

tell application "BBEdit"

                set mywindow to make new text window

        make new text document at mywindow

It seemed to work every time
if bbedit doesn't have a window open it opens it
and if the doc window is open it just adds another untitled to the list
don't know if this will help, but hope it does.
