I think the people who are saying they've copyrighted their layouts just own the copyrights to the names of their layouts. (which probably is not a very hard thing to do) As you are talking about earnings I think you're actually talking about patents. And patenting layouts is indeed possible in the US. Both QWERTY and DVORAK layouts had been patented by their inventors.
