It appears at first glance, among other things, that if you submit something to Geekdo, they have the right to transfer or sublicense that content to another party as a way of promoting Geekdo. 4D It appears likely that Geekdo could start selling laminated User Submissions through the GeekStore with a Geekdo logo and define it as site promotion.
Geekdo can retain deleted and removed content, but they may not distribute, display, etc. it. In other words, don't assume that deleted/removed content is necessarily gone gone. 4F You may not scrape the site (although I assume they will still let Google do it). 5B It is odd, but even though there is a Marketplace and GG Auctions, there appears to be a prohibition on the use of the communication systme (GeekMail, I assume) for commercial solicitations in 5B. This seems overbroad and was probably intended to be outside of the scope of the site, as defined solely by Geekdo, as is mentioned in 5D. I don't see them enforcing these ToS against game sellers, so long as they pay their 3% 5B and 5D seem to be in slight conflict, but I assume 5D controls. You cannot use the content on the website in a way that would lead to "the effect of competing with or displacing the market for Geekdo". 5D If Geekdo goes away, we are all up the creek. It would be great if the owners of Geekdo could put a copy of the DB in escrow somewhere so that it could be revived or scraped if and only if Geekdo disappears. Geekdo can amend the ToS at any time without necessarily informing you. That is my quickie read. - Jonathan As someone else's sig line reads, "If this had been legal advice, it would have been followed by a bill."
