On issues of copyright and digitization, I highly recommend the following
guides as an introduction:

Hirtle, Peter B., Emily Hudson, and Andrew T. Kenyon. Copyright and
cultural institutions: Guidelines for digitization for U.S. libraries,
archives, and museums. Ithaca, NY: Cornell University Library 2009.
http://ecommons.cornell.edu/handle/1813/14142

Hirtle, Peter. Copyright term and public domain in the United States as of
January 1, 2011. Ithaka, NY: Cornell Copyright Information Center.
 http://copyright.cornell.edu/resources/
These guides focus on U.S. copyright law. They touch on international law,
but as it has impact on digitization in libraries in the U.S. A
digitization project based elsewhere would require researching the laws of
that country and any international agreements it may be party to.
