There are some problems with this. First of all, the preview is not a single view, we can swap in all kind of views all of which handle their own context menu. A popup would mean some annoying layout stuff (in particular inside the horrendous split view). And it would mean an almost empty horizontal space with a single small popup somewhere at the end, which probably won't look to nice. So we have to think about this very hard before trying to add this. But even though it makes it easier to switch between different templates, it actually makes it harder if you just use one template for the preview. Anyway, there is a good chance the preview pane stuff will get some overhaul, as per a recent discussion.
