Part of the problem with requesting the "back money" that they owe us is that the federal government "rescinded" some of it recently. We had these outstanding balances of "unspent" TE "money" (obligation authority)...but we had to give some of it back.

The other argument that they are giving me is that...it's not that they aren't SPENDING TE...it's just that they are spending it on things like landscaping and paved shoulders for highway projects. My thought is that highway funding should pay for those things to make it a "complete street"...but they are legally allowed to spend TE for those things.

The program that is getting screwed is the Local Transportation Enhancements...or the money that pays for bike paths/lanes/etc in lots of communities all over the state based on those communities' needs and plans.

So the numbers you want the DOT will likely say don't exist.

You're counter argument could be that they SHOULD have been giving 10% of STP (Surface Transportation Program) fund to the local program all along. Since 1992 WisDOT has spent $87.6 million on the local enhancements. They could have probably spent something like $270 million is they had wanted to. That's not a hard fast number, just an estimate of 10% of STP-D from 1992-2007. So the difference is $182.4 million.
