This article implies that the driver was not trying to flee, or
intentionally strike cyclist:

"Norton got back in the car and apparently tried to move it out of
traffic, but ran over Morgan again."
So the second hit, like the first hit, was "an accident". Not
"culpably negligent"? How careless do you have to be before you meet
that criteria?
Also, FTA:
In his blog, Morgan says an amendment to the "3-foot law" is being
drafted to be introduced by Rep. Margaret Ellis-Rogers, R-New Albany
Quoting [email protected]:
From the linked article (Allgood is the DA):
"Allgood says he has seen the Highway Patrol accident report and there was
no felony because the motorist didn't leave the scene, wasn't impaired,
and didn't intentionally or negligently hit Morgan."
If she got out and saw the cyclist, then got back in her car and started
it up, what could she possibly have intended to do besides 1) leave the
scene or 2) strike the cyclist again ?

Running over the cyclist after the initial incident would have to be at
least assault with a deadly weapon. I see these as two separate actions.
The motorist stopped. Got out of the vehicle. Ran over the cyclist
again.*
