This reflects a bit of dark humor from the days when personal injury litigation was on the uptick (1960's - 70's). The "joke" was that the best legal strategy when you run someone over was to back up and finish them off. At least we THOUGHT it was a joke. Sooner or later every urban legend comes true, I guess. Snopes.com calls it "ostension."
