I just ran into this problem. I added a folder with the 'Add To Catalog' action, hit 'i' then 'Contents', and then tried to change the depth. No response from the black numbers (1-3), the grey ones (4-7) or ∞. The contents of the folder are only one folder which contains another folder (so max. depth = 2).
I solved it by relaunching Quicksilver. :) I can select any depth I want now.
