not being properly added to the audio group
this once corrected removed a great deal of the errors initially encountered
i also was over looking the output settings within alsamixer center was not
set to mixer output rather i had disabled it setting it to mixer output
produced sound and all was well

Compileing alsa stuff into the kernel rather then as a module should
be recommended in my belief. It also seams to fix about 99% of all
sound related issues. if you rely on alsaconf tho this is a bad idea
as it only sees stuff that are modules and not kernel built stuff.
Ohh and expect alot of really annoying udev complaints.
PS: i consider alsaconf to be bugged because of this. but as im not
willing to fix it myself you can write me off as a psyco. :)
