Well, allot of that depends on copyright laws, and of course weather or 
not the company/individual renews the copyright.
I don't know specifics, but I do know they can hang on to the copyright 
for many years after the software is dead and buried. I mean most Atari 
games ended up in the scrap heap,  what remains is traded around for 
collecters. However, Activision has continued to renew those games in US 
copyrights, and have republished them in different ways. For example 
Activisions Asteroids 98 for Windows 98. They also had a new version of 
Missile Command a couple of years back, the new tv games that are out, 
etc...
I am sure Nintendo is no different. Just because the original games are 
dead and gone that doesn't mean they will not continue to hold on to the 
copyrights and come out with new versions down the road.
