And it will need to be documented in a reference linked to from the disclosure. My guess, though IANAL, is that the non-MBA numbers ISPs use will be refined over time through the back-and-forth of complaint & inquiries until it becomes more clear what the smaller number of acceptable measurement methodologies are, and this will take quite some time (and perhaps be a bit messy).
