I wouldn't be to quick to judge the labor rate.  Richard didn't tell
us where he's from, and that can make a big difference.  Here in the
San Francisco Bay Area, the rate for a good independent shop can be
$90 per hour, and dealers charge $100-150 per hour.  Cost of living, 
you know ...

My local dealer started offering tyre replacement services a while back, and
they were cheaper than all the chains.  They only offered OE tyres, which
was probably why they were cheaper.  I've no doubt they farmed it out to
another outfit - I never saw any tyre-fitting facilities in the shop.

I wouldn't ever go to a BMW dealer for an alignment.  Book time is 2.5 hours
(or �280 in London), they couldn't figure out how to make their
song-and-dance Beissbarth machine work when the car was fitted with AC
Schnitzer suspension (BMW-approved parts) featuring a whopping 20 mm lower
ride height, and when I asked for slightly less toe-in at the front I was
told it was forbidden (by whom?  The bloody European Commission?).

Luckily this was the first time the dealer had ever used a customer's car on
their new kit, and they only charged me a few quid for the extra half-hour
of head-scratching required to deal with non-default suspension settings.
Never going back, though.

This may have not been on my BMW 88'325ic, but on our
02' Volvo XC when I added the tow kit (weight 85lbs)
it made a noticable difference in the way the car
turned into corners and rode on the highway over the
expansion joints.

This is what I was going to say with a little more
tech added though....

A friend owns a tire dealer and the M cars wheels have
been a PITA since the begining. In fact he does them
himself (normally at the front desk) to save his paid
labor the 2 hours time.

Sue him....Simple as that....That will get his
attention. Have an expert BMW shop write a swown
statement for the judge that it is garbage and you
should have no issues. I assume you have quite a paper
trail to go with this testifing to the condition of
the unit?

Interesting non-BMW related experience:
Last month I took my Subaru Forester to a new America's Tire Company 
store in town. I knew their inventory so when I walk in at 10:50 AM. I 
know what I want, ask the price and toss them the keys. While the desk 
guy and I finish the paperwork, his 3 shop guys are already dismounting 
tires. After the paperwork's done he goes out to help them balance. 
They had quite an assembly line going there.  Care was taken at every 
step and torque sticks are followed by careful hand torqueing. I drove 
out of there at about 11:05 on new rubber feeling like I had my own 
personal pit crew. Except I was still driving the Forester.
