Yes, it is an old bug. Not particularly easy to patch... What happens when you upgrade? If you have custom site files none of them should be over written---unless you edited the system files directly (not recommended!). But there are options. 1) just upgrade the scripts folder. 2) backup the the changed site pages in your system folder, upgrade, then overwrite them again with your backed up copies. 3) Copy your edited folders to your local field pages folder. Probably other solutions as well. I'm not 100% comfortable with the new code, but enough to upgrade all my production sites, so it's coming along...
