Hi Folks,
I had an excellent meeting with Bert today. I feel
a lot better about things. In fact I feel positive
about the process again.
The meeting with the SAPS which was held on the
14th of May did not go well at all and I was
most despondent about the process after that one so
much so that I requested another one meeting and I
now feel much better about our future as traders
in used books under the new SHGA.
_*Constitution :*_
We have re-written our constitution (as we keep
telling you). It has almost been approved by the
SAPS and just needs a spot of tweaking. The new
one will be circulated for comments next week.
_*Licenses.*_
Forgive me for repeating myself, but this is the
process that bothers me :
Apply for license - > Receive receipt of application -
> Receive License -> Comply with *ENTIRE* SHGA.
Now, my problem is that there will be a gap
between receiving your actual license and the
gazetting of exemptions (hopefully some, hopefully
many) specific to SABDA. During this gap, we will be
at the mercy of the local police force who may
fine you for every single transgression. I cannot
comply with every aspect of the SHGA it is
impossible for me and I am not the only one in
that situation............so I am not prepared to
make myself vulnerable to such a situation and
legally speaking, I don't need to register until the
31st of July. Bert has said the exemptions will be
gazetted by the 31st of July.
So, we have decided on the following plan :
I will write to Bert (Brigadier van der Walt) asking
if it is indeed correct that we are under no
legal obligation to register to become a dealer
prior to the 31st of July 2012.
He will respond to me stating that, yes, that is
correct, no dealer may be forced to register prior
to the 31st of July.
I will circulate that letter to the Book-link list
and the SABDA membership. Some police people are
telling dealers that they have to register within 2
days &c. &c.
You will then each have a document to fall back
onto should your local police tell you that you
have to get your ducks into a row NOW.
Should the exemptions not be gazetted prior to the
31st of July, I shall be back on Bert's
doorstep...........I will cross that bridge when I
get to it.
I really, really would like to say, please hold-off
from registering at this point.
_*R100. *_
My interpretation of the Act is 90% correct and
that is good enough for me.
If your entire stock consists of articles with a
cost price of less that R100 / item then you are
not a dealer in SHG (in terms of the definitions
of the Act) and you do not need to register as
such................the entire Act does not apply to
you and in fact you do not exist :-)
There is a technical argument that takes up the
other 10%, but it really isn't worth worrying about
as book dealers.
I receive at least 3 e-mails or phone calls a day
from dealers around the country expressing some form
of panic, uncertainty or discomfort.
I realise that this situation is far from ideal.
There is a lot of uncertainty. This phase of the
SHGA was only supposed to be rolled out in October,
after the exemptions had been gazetted and now I
feel as if we are working against the clock.
We are working as fast as we can.
