Its probably irrelevant.
If the EU practice was in violation of the WTO Treaties, then the US could
file a complaint against said policy in the WTO.
If the WTO agreed that the EU policy was a violation, then the WTO would
simply declare the US to be "morally justified" in instituting retaliatory
policies (perhaps such as the one in question) of certain size.
